OMARUAYE VS DEFINONE: Tribunal Grants Omaruaye’s request to present Expert Witness

The Delta state election petition tribunal sitting in Asaba, the Delta state capital, has granted the request of Mr. Peters Omaruaye, through a unanimous decision, to present an expert witness in his petition against the declaration of Chief Ede Dafinone as winner in the Delta Central Senatorial District election.

Mr. Omaruaye was the APGA Delta Central Senatorial District candidate for the Delta Central Senatorial seat in the last general election and he contested against Ede Dafinone of the APC and Chief Ighoyota Amori of the PDP.

Ruling on the petitioner’s request to open his case with the expert witness on friday 23rd, the three man panel of Justices in a unanimous decision granted the petitioner’s request saying that he had met all necessary requirements.

Mr. Peters Omaruaye of the All Progressive Grand Alliance (APGA), is challenging the declaration by INEC of Chief Ede Edefinone, of the All Progressives Congress (APC), as winner of the  Delta Central Senatorial District election for Non Compliance with the Electoral Act.

After the conclusion of pre-hearing in may, the tribunal had fixed June 21st and 22nd for the petitioner to open his case.

On wednesday 21st of June, the petitioner through his counsel, Barrister Diejomaoh, presented an expert witness as his first witness to open the case.

However, this was objected to by  the 1st, 2nd and 3rd respondents, Chief Ede Dafinone, the APC and INEC respectively.

Subsequently, the tribunal adjourned to friday 23rd for ruling on weather the expert witness should be allowed or not.

After the ruling the tribunal fixed 8th and 12th of July for the petitioner to open his case.
